Buyer: The person or organization that submits information through the order, quote, payment, membership or service activation screens.

2. Definitions and Subject

This agreement regulates the rights and obligations of the seller/service provider and the buyer regarding the remote sale or supply of Fixtra products and services, including physical products, software, subscriptions, APIs, AI services, mobile applications, firmware, cloud platforms, digital downloads and related support or integration services.

3. Product and Service Information

The main characteristics, price, currency, taxes, payment method, delivery method, activation period, subscription conditions, license limits, compatibility requirements and special terms are presented on the product page, checkout page, quote, order form or written agreement.

4. Ordering, Pricing and Payment

Orders are created when the buyer confirms the cart, legal documents and payment step. Payments may be collected by credit card, debit card, bank transfer/EFT or other agreed methods. Online payments may be processed through iyzico over SSL-secured infrastructure.

5. Physical Product Delivery

Physical products are shipped to the delivery address provided by the buyer. The buyer is responsible for providing complete and accurate delivery information. Risk and delivery consequences are evaluated according to applicable law and the selected delivery method.

6. Digital Product and Service Delivery

Digital delivery is completed when access, license, account activation, download link, API key, firmware package or cloud service access is provided. SaaS, AI, API and cloud services may be subject to usage limits, subscription periods, fair use rules and technical availability conditions.

7. License, AI Services and Updates

  • Software, firmware, APIs and digital products are licensed, not sold, unless expressly stated otherwise.
  • AI-generated outputs may vary and should be reviewed by the user before operational, legal, financial or safety-critical use.
  • Firmware and software updates may improve security, compatibility or functionality, but may require compatible devices, operating systems or network conditions.

8. Compatibility and User Responsibilities

The buyer is responsible for checking technical compatibility, environmental conditions, power, network, device requirements and integration prerequisites before purchase. Installation, configuration or integration services are provided only if included in the order or separately agreed.

9. Right of Withdrawal, Exceptions and Returns

Consumers may exercise withdrawal rights where applicable. Withdrawal may not apply to digital content or services started with buyer approval, customized products, activated licenses, downloaded software, personalized integrations or B2B transactions governed by separate commercial terms. Return and refund details are governed by the Refund, Return and Delivery Policy.

10. Warranty and Liability

Statutory rights for defective products are reserved. Except for mandatory legal obligations, Fixtra is not liable for indirect losses, loss of profit, business interruption, data loss, misuse, unauthorized modifications, incompatible environments or third-party service failures.

11. Intellectual Property and Accounts

All intellectual property rights in Fixtra software, documentation, designs, firmware, platforms, APIs, trademarks and content belong to Fixtra or its licensors. User accounts and credentials must be kept secure and may not be shared or used unlawfully.

12. Force Majeure, Export and Governing Law

Neither party is liable for failure caused by events beyond reasonable control. Products and software may be subject to export, sanctions, cybersecurity or sectoral compliance rules. This agreement is governed by the laws of the Republic of Türkiye unless mandatory consumer rules provide otherwise.
